Before the Court are two separate Federal Rule of Civil Procedure (“Rule”) 12(b)(6) motions to dismiss–one on behalf of the Village of Downers Grove and Nicholas Linklater and the other on behalf of Officers Bylls, Yocum, Steik, Maly, Karmia and Mayyou. Also before the Court is Defendant Village’s motion to strike the prayer for punitive damages. For the reasons set forth below, the Court grants the motions in part and denies them in part. Civil Rights Lawsuit settled for Millions of dollars

Often times civil rights lawsuits can settle for large amount of money prior to the cases going to trial. This can be good for both sides and insulate them for the risk associated with a civil rights trial.
